Privacy Policy
PRIVACY POLICY VINbattle, LLC (“VINbattle,” “we,” “us,” or “our”) is committed to protecting the privacy of our website visitors, sellers, dealers, and other users of our services. This Privacy Policy explains how we collect, use, disclose, retain, and protect personal information through our website (vinbattle.com), our online vehicle marketplace platform, and any related communications and services (collectively, the “Platform”). By using the Platform, you acknowledge that you have read and understand this Privacy Policy. If you do not agree with its terms, please do not use our services. 1. Information We Collect A. Information You Provide We collect information you provide directly to us, including when you create or update an account, submit or manage a vehicle listing, participate in bidding or auction activity, complete or attempt to complete a transaction, pay fees, verify dealer credentials, manage notification preferences, or otherwise communicate with us. The information we collect may include: Account and identity information: first and last name, email address, phone number, ZIP code, user type, login credentials, and authentication information. For dealers, we also collect business legal name, DBA, EIN, dealership license number, license type, issuing state, license expiration date, business phone number and business address. Listing information: vehicle VIN, make, model, year, trim, color, mileage, title status, loan payoff amount and lender, reserve price, condition disclosures, inspection results and reports, and user-photographs you upload, and other listing information you provide. Vehicle listings are visible to verified dealers on the Platform. Transaction information: bids, offers, acceptances, declines, payment records, payment amounts, payment status, and walk-away records. Payment card information is collected and processed by our payment processor, Stripe. We do not store full payment card numbers. Communications: emails we send and their delivery status (delivered, bounced, complained), customer support correspondence, and your notification and communication preferences, including opt-out requests. Marketplace and behavioral information: seller wish lists, desired makes and models, price ranges, location radius, dealer inventory, saved searches, match records, auction and listing interactions, and walk-away history. Technical and usage information: IP address, user-agent, device and browser type, pages viewed, links clicked, dates and times of access, analytics data, and similar usage data collected automatically through the Platform and service providers. B. Information Collected Automatically When you access or use the Platform, we and our service providers may automatically collect technical and usage information, including IP address, browser type and version, device identifiers, operating system, referring URLS, pages viewed, links clicked, dates and times of access, auction and listing interactions, email delivery and engagement data, and similar information. We use this information to operate, secure, monitor, troubleshoot, and improve the Platform; understand how users interact with our services; prevent fraud and abuse; and maintain marketplace integrity. C. Cookies and Similar Technologies The Platform may use cookies, pixels, web beacons, scripts, tags, and similar technologies. Some of these technologies are necessary for the Platform to function, while others may be used for analytics, security, performance measurement, personalization, communications, or advertising-related purposes. You may manage cookies and similar technologies through your browser settings and, where available, through our cookie or preference tools. If you disable certain technologies, some Platform features may not function properly. 2. How We Use Your Information We use the personal information that we collect about you or that you provide to us, including any personal information, for the purposes described below and as otherwise permitted by law: To operate and administer the Platform, including creating and managing accounts, publishing listings to verified dealers, running auctions, sending notices about offers and outcomes, processing transaction fees, and facilitating completion of accepted transactions; To verify dealer eligibility, review account information, prevent fraud and abuse, enforce our Terms, and maintain marketplace integrity, including walk-away tracking and related records; To communicate with you about your account, listings, offers, transactions, support requests, policy updates, and other service-related matters; To send product updates, promotional communications, or other non-transactional messages where permitted by law or with your consent; To match seller wish lists with dealer inventory for users of Connect features; To analyze usage, improve functionality, develop new features, troubleshoot issues, measure communications, and maintain the security and performance of the Platform; and To comply with legal, tax, accounting, regulatory, and reporting obligations and to establish, exercise, or defend legal claims. We process personal information for the purposes described in this Policy where necessary to take steps at your request, perform our contract with you, comply with legal obligations, and pursue our legitimate interests in operating, securing, improving, and administering our Website and services, preventing fraud, maintaining internal administrative oversight, and supporting our business operations. Where required by applicable law, we will obtain your consent before processing personal information. 3. How We Share Information We do not sell your personal information. We may disclose personal information in the following limited circumstances: Between transaction parties. When a seller accepts a dealer’s offer and the transaction fee settles, we share the seller’s and dealer’s contact information with each other so they can complete the sale. This is core to how the Platform works. Service providers. We share information with vendors and service providers that perform services on our behalf and are authorized to use personal information only as needed to provide those services. These providers may include Supabase for database hosting, authentication, and file storage; Vercel for application hosting and request logs; Stripe for payment processing; Resend for transactional email delivery; Google Analytics 4 and Vercel Analytics for usage analytics; and the NHTSA VIN-decode service for vehicle decoding. These providers may receive personal information in identifiable form where needed to perform their services. Legal and safety. We may disclose information to comply with law, legal process, or enforceable government requests; to enforce our Terms; or to protect the rights, safety, or property of users, the public, or the Platform. Business transfers. If we are involved in a merger, acquisition, financing, or sale of assets, information may be transferred as part of that transaction, subject to this Policy. We do not sell your personal information, and we do not share it with third parties for their own independent marketing and advertising purposes. We use service providers to operate the Platform, and those providers receive information as needed to perform their services. 4. Your Choices and Rights Certain U.S. state privacy laws provide residents with additional rights regarding their personal information. VINbattle is designed primarily for residents of Maryland, Virginia, and the District of Columbia, although individuals from other states may also access and use the Platform. The exact scope of these rights may vary by state. Depending on your state of residence, you may also have the right to appeal a decision regarding a privacy-rights request. The following sections describe additional rights that may be available to residents of Maryland and Virginia under applicable law. A. Maryland Online Data Privacy Act (MODPA) VINbattle acknowledges the Maryland Online Data Privacy Act (Md. Com. Law § 14-4701 et seq.), effective October 1, 2025. To the extent VINbattle processes personal data subject to the MODPA, Maryland residents may have the right to: Access personal data we hold about them; Correct inaccurate personal data; Request deletion of personal data, subject to applicable exceptions; and Opt out of certain processing activities. To submit a request under the MODPA, please contact us at privacy@vinbattle.com. We will respond to verifiable requests within 45 days as required by law. Note that many exemptions may apply, including for data processed in connection with employment or professional membership relationships. B. Virginia Consumer Data Protection Act (CDPA) VINbattle acknowledges the Virginia Consumer Data Protection Act (Va. Code § 59.1-571 et seq.), effective January 1, 2023. To the extent VINbattle processes personal data subject to the CDPA, Virginia residents may have the right to: Access personal data we hold about them; Correct inaccurate personal data; Request deletion of personal data, subject to applicable exceptions; and Opt out of certain processing activities To submit a request under the CDPA, please contact us at privacy@vinbattle.com. We will respond to verifiable requests within 45 days as required by law. Note that many exemptions may apply, including for data processed in connection with employment or professional membership relationships. 5. Data Retention We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, including to provide and administer the Platform, maintain accounts, complete transactions, prevent fraud, resolve disputes, enforce our agreements, comply with legal, tax, accounting, and reporting obligations, and protect our legal rights. When you delete your account, we permanently remove your personal profile information (such as your name, email address, phone number, and ZIP code). Records we are required to keep for tax, accounting, and dispute-resolution purposes — including transaction and payment records, and, for dealers, your executed dealership agreement and dealership license identity — are retained in de-identified form, disassociated from you as an individual, for up to seven (7) years, after which they are purged. If your account has no transaction history, it is deleted in full. 6. Data Security We use reasonable administrative, technical, and physical safeguards, including encryption in transit, access controls, row-level database security, and passwordless email-link authentication. No method of transmission over the internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. Please protect access to your email account, since it is your sign-in credential. 7. Children Under the Age of 18 The Platform is not intended for children under 18 years of age. No one under age 18 may provide any personal information to or on the Platform. We do not knowingly collect personal information from children under 18; If you are under 18, do not use or provide any information on this Platform or through any of its features, register on the website, or provide any information about yourself to us, including your name, address, telephone number, or email address. If we learn we have collected or received personal information from a child under 18 without verification of parental consent, we will delete it. Residents of certain states under 13, 16, or 18 years of age may have additional rights regarding the collection and sale of their personal information. 8. Changes to This Policy VINbattle may reserve the right to update this Policy from time to time at its discretion, as the Platform evolves, including in connection with any subsequent brand name changes. Changes will be posted in this updated Policy and will be effective upon posting. We will notify you of material changes by email. Your continued use of VINbattle after changes have been posted is deemed acceptance of those changes. It is your responsibility to monitor this Policy to determine whether any such changes have been posted. 9. Use of Automated Tools We may use automated tools to support marketplace operations, such as matching seller preferences with dealer inventory, applying auction rules, and calculating dealer walk-away metrics. Account suspension or removal decisions are reviewed by personnel and are not made solely by automated means. 10.
